Hiya we are currently have problems with our brother over the ashes, we are wondering who collects them and who has rights to where they go, as our mother never put anything in the will about them, if you could help tha would be great many thanks

If nothing is said about the ashes in the will, then the executor of the estate is responsible for making the decision of how to dispose of them. Is your brother the executor of your mother's estate? If so, he should be aware that there are state laws as to what can (and can not) be done with them.
