I have a 2 year old son and would like for my fiancé to adopt him. His biological father is on his birth certificate, but has not seen him in almost a year. I put him on child support when our son was born but he is FAR behind. My main problem now is that I don't even know how to contact him. He has moved out of the state and does not contact me at all. What can I do?

It is harder but your attorney doing the adoption can follow court rules for attempts to contact your ex. If he can not be found, the courts may allow the adoption.

It works easier if you find him and he signs off.

If not, you will not be sure till the judge rules.

I highly recommend ANYONE doing an adoption have an attorney prepare the paperwork. There are too many gotchas to not make sure the paperwork is done right.

So what you should be doing is shopping around for an attorney. The attorney will tell you when your fiancée can adopt (usually you have to be married for a period of time). They will tell you what you need to do get the bio father to agree or how to show a good faith effort that you tried.

1. Get married.
2. Stay married for at least a year.
3. Go to attorney for him to start adoption paperwork. He'll figure out how to get around absent father.
4. Go before a Judge at a hearing.
5. Have Judge grant the adoption.
6. Live happily ever after as a happy family.
