I was in a car accident, it was my fault, within 2 days, I had a estimate , and decided on one of the shops, my claims adjuster, approved the repair, and told the shop it would be covered. I get a call about 10 days later by the insurance company total loss dept. there are thinking about totaling my car. My car is already repaired, just waiting on the paint job. The repair shop has the check, and all I have to do is sign the check. Can they total my car after it was approved to be fixed by the claims adjuster

Have you already paid the deductible to the repair shop? One thing to check out is whether the blue book value of your car is in fact less than the repair bill. If it is, then it seems to me that they can declare it a total loss, regardless of the fact it's been fixed, as long as you haven't already paid the deductible on it. When they declare the car as a total loss they basically take ownership of the wreck and reimburse you for its value, less your deductible. What they then do with the wreck is immaterial - they can decide to fix it, or junk it, or whatever. So if they're willing to write you a check, and of course they also have to write a check to the shop for the work that's been done, then you're OK.
