A roommate is constantly using drugs after being told to stop. There are other roommates who going to college to become teachers and if we get in trouble due this one person, then it would ruin their careers. How do I evict this roommate? I live in Arizona. How many days can he stay at my house after I hand him the eviction letter?

Hello d:

Are YOU his landlord?? Or are you just a roommate? Only his landlord can institute these proceedings. If there is ONE lease/rental agreement, then you're tenants, and the landlord is going to have to evict ALL of you. If you ARE the landlord, then you have separate agreements with each tenant...

So, you're probably NOT the landlord. Is it just pot, or is he tweaking out? Maybe there's a better way to handle it.

The lease &/or the landlord-tenant statute in your state may provide that a tenant can be evicted for criminal activity occurring in the premises. If so, you could demand that the landlord evict the offending tenant. Yes, the LL might evict all of you, on the other hand he/she would probably be willing to allow you to remain, amend the lease to pick up a new room-mate, etc. Exactly how this could be done would depend on the status and terms of your rental agreement, lease, or whatever you have.
