We got married in 1996 and have two children. My husband baught a House in GA in 2007 by paying cash for it and the title is only in his name for the house and there is no loan or mortgage on it. With bad economy bad days have come along and we need to sell the house and we have a Cash Buyer who will pay Cash for the house. My husband has a clear title and he did buy title insurance when he baught the house, Now, while sellilng it please tell me (1) - can he sell the house all by himself or does he need any intervention from me like filing a quit claim or something (2) - Must we go to a closing attorney or save the money by signing the paper work in front of a Notary public and then submitting it to the court house for Recording by barely paying the Recording Fees. The House does not need a Survey as there is a well defined Plat and Proprey Description in frot of us from the previous Deed when my husband had baught the house and we did buy the title insurance on it too. (3) - Can the buyer buy Title insurance on it again even when there is no Closing Attorney present representing the deal - if yes then the Title insurance company can do the Title search and sell the insurance on it. The reason we are trying to save on Closing Cost because in Negotiations with the New Buyer we have Negotiated that the Seller will pay the Closing Cost and the New Buyer will pay for the Title INsurance. If we could close the house just with the help of a Notary Public and Recording Fees and Title fees we will save about $500 to $700. Thanks for your advise.
