My husband and I were caught stealing approximately $100 worth of merchandise at a zellers store in ontario. The staff recovered all items that we had taken, and the police were called because I did not have any id on me at the time. The officer issued us a notice to appear in court next month and also for fingerprinting. We have never done anything like this before. We do not have any prior records of may kind. The officer also said that he would have to notify the Children's Aid Society because we had our daughter with us she is one year old. He said that CAS would call us by phone to question why we had her with us at the time. I just want to know what CAS will do, will they take our daughter? What will happen in court? Are we going to have to spend any time in jail or will community service be given? Should we take a lawyer to our court date??

Yes, they can take custody of your daughter, particularly if you used her in any way in the crime. Someone once posted that they lost custody because they put the stolen merchandise in the baby's diaper bag.

What will they do in your case? I don't know.

I personally would not handle this without an Attorney - you have a lot at stake.
