Hello,
I have kind of a complicated situation with my son and his father. His father is not his biological father, so after birth he went to his attorneys office and had his name taken off the affidavit that he signed at birth. He has always been his father and played the role and our son needs health insurance that I can not provide but he can but our son does not have his last name to just be put on his insurance. Now we have talked about it and he wants our son to have his last name again. He went back to his attorneys office and talked to them about it. So now it is either guardianship or adoption. I'm very confused between the both. I don't want to loose my son in the midst of all of this just because I didn't fully understand so if anyone could please help me with this that would be amazing!!

Do you know who the bio dad is or where he is at?

Guardianship is normally temporary and revokable. The problem is that if you're the one giving up guardianship then he could later move to remove you as parent. There are no rights that go with guardianship.

Adoption is different. In adoption there are rights beyond that extend to inheiritance etc. Also should you split up under adoption he would be liable for child support.
