I have a five year old and me and the girlfirend just broke up I have raised this boy since he was 17 days old and was there for him for 5 years when the father couldent be there he was never around but I am not the biological father do I have rights in the court system to be able to see this boy

Maybe, maybe not. If you have not been declared the legal father you have no rights. But you may be able to gain those rights by proving you have acted as the boy's father for all these years.
We can't give a definitive answer since laws vary by area and you didn't provide that info. My best suggestion is to con tact a Family Law attorney in your area who can advise you about local laws.

OK sorry I live in sudbury ontario canada and the only thing I really have is photos and proff from family and mutual frinds
