View Full Version : How to gain rights if I'm not on the birth certificate?

My son recently turned 1 this past July 2010. My baby mama and I get along sometimes but not really that often. I'm researching to find out what I need to do in order to see my son and have rights etc. I'm not on the birth certificate as I wasn't able to be there when he was born due to me being on probation in nc where she lives and he was also born in wv. Therefore I wasn't allow to leave state to be there and sign. I've only seen him 6times his who life but trying to change that and she being difficult. I recently got off probation this August and seen my son in September for the first time in like 6 months but as I talked to her today and tried to ask to see my son she told me "i can see my son when she wants me too" I just need some help on where to start so I can see my son. I currently live in nc still and their in wv but I'm willing to do anything even go up there every weekend just to visit as long as I can be with him. What do I do? Also not sure if it matters anything but she's the one on probation now so she can't leave the state for me to see him, which she wouldn't anyway due to the fact I have a steady girlfriend now whom I choose over my bbymama when I went in September where my babymamas mad over that and won't let me see him because I'm not with her, really some childish things but my babymama is only 18, I just turned 23. Please someone let me know what I can do or how to go about this, thanks...

I am sure someone else will come over and move this to family law, ( I normally do, but for some reason it is going crazy tonight)

All you have to do is file for partial custody or child visits in court, you may have to prove you are the father though DNA.
