View Full Version : Minimum time to apply for green card on an L1A

Hello. I am currently on L1-A and my visa expires Jan ,2011. I have applied for extension for recapture of days which will be nearly 70 days since this is 7th year on L1. My company has agreed to do green card. Is it too late now to apply for the green card?

You have time to file for the green card. You probably don't have enough eligibility to keep your L-1A during the entire time of the EB-1(3) and AOS.

Extend the L-1A long as possible; and make sure the attorney files for the EAD and the AP. If you need to travel, try to do so during the validity of the L-1A visa. Be sure that the I-140 is well prepared, especially the "ability to pay" as this is the most common RFE currently.

Make sure the company attorney has some experience. Generally not a difficult case as you are an L-1A already so half of the case is proved up, unless conditions have changed. Good luck.
