Me and a friend just recently signed a lease in novemberr jointly. She in 1 month has become extremely difficult to live with. But my landlord told me that in order to break the lease both must agree and of course she will not agree. I this true? Or can I terminate my part.

Hello lil:

Yeah. For all intents and purposed, the two of you formed a (legal) partnership to rent this place. The landlord rented to the partnership, so it's the partnership that needs to deal with the landlord.

But, even IF she did agree, I doubt he would let you break the lease. This is just his way of passing the buck.

So, you have to decide between the lesser of two evils - living with a bad roommate, or getting sued.

Of course, if you leave and your roommate doesn't and keeps paying rent, the lease hasn't been broken. She may even have the ability to sub-let. Or, you can stay if she wants to go.

Tell your landlord that despite your requirement to have her alongside, you ARE going to move. IF he wants to keep HIS property rented and keep YOU as a tenant INSTEAD of her, he is going to have to get involved.
