I receive a court summons for an car accident my husband had in August 2008. He died ten days after the accident. He had full coverage they said my husband car was total and they settled with the other driver. Two years later he is trying to sue my husband's estate namely me. Can he do this ? Do I really have to show up for court. Please help!

Did they sue you in your capacity as personal representative of your husband's estate? Are you a PR appointed by the probate court? If so, yes they could get a default judgment against the estate if you don't answer the complaint (Normally a summons doesn't require you to "show up in court", but just file an answer.)

If you are not PR, I don't see how you could be liable. Consult an attorney.

How was the car registered? Both names? Just his name?
