View Full Version : Can you file a motion for sentence reduction on state charges

My husband was charges with distribution of 4 grams of cocaine. He was sentenced to 4 years in state. He offered to help in any way possible to get a reduced sentence. I myself offered to help the vasp bring down some heavy drug pushers on behalf of my husband to get a reduced sentence but the commonwealth was more concerned about my husband doing a 4 year sentence on a first time drug offense of 4 grams than bringing down suppliers of large quanity. Would it help to write the judge that did the sentencing and tell him what was offered to the commonwealth attorney in exchange for a reduced sentence? If anyone has advice please respond.

No, it does not help, the judge really does not care, nor is it his job to interfere with plea bargains.
Next I guess you did not just give info on worst criminals to be a good citizen ? They may already have someone undercover or this other person could be doing something for them theirself. No way to tell.
Next often esp if they are elected, they want a lot of visible drug arrests.
But after the conviction and sentence there is nothing you can do.

Sure you can. But if the grounds for it are the DA didn't do a good job, it ain't going to be granted.
