View Full Version : My daughters dad took her without permission and refuses to let me see her

I have a month old daughter , she was very sick when she was born . She was in the nicu for a week I was there about 4 times a day and would go to rounds to see how she was progressing. Her dad on the other hand went about 2 and for an hour or so .Him and I were recently trying to work on things and get back together , during this time I was living with my sister and her husband . Yesterday we took our daughter to the doctor , after we talked about us and our relationship I told him I was unsure what I was going to do . We went to the gas station and he left me there and took off with my daughter in the car. I called the police but they were unable to do anything because he is the father and is on the birth certificate. I talked to him and he refuses to even let me see her let alone bring her back to me , because he is filing for full custody . He said as soon as the custody battle clears up he will let me see her , is he aloud to do that taking it she is only a month old? I am scared that I won't win the custody case because Im not working and am not as stable as he is with a car nor a proper home of my own . What should I do?

Well, I would have gotten an attorney and filed for an emergancy custody hearing in court the next day, ( so you are just sitting around and waiting for him to file in a day, a week or a month or so, with a hearing maybe 3 or 4 months in the future after he files ?)

I would ask for an order for temp custody or at least temp visits.

Supposably he already talked to his lawyer and is planning to draw up those papers with his lawyer tomorrow I believe. But it takes about 20 days or so to serve me with the papers to go to court for custody . He told me to sign the papers and he would let me have her and what not as if trying to blackmail me to sign them but I told him I wouldn't just hand her over like that I would fight for her or at least attempt to fight for her . So can I still file for an emergency hearing? It happened yesterday that he took her. Im not working so I'm going to go speak with a legal aid tomorrow to see what I can or should do . Should I talk to the legal aid then go file for the emergency hearing for the next day? How do they do the whole temp custody thing?
