View Full Version : My son's biological father is facing murder charges, can I change his surname?

I have been divorced from my ex-husband for 5 years, and we have a 10 year old son. I have since remarried, and we have primary custody. My son's father has been in a steady downward spiral for the last several years. I found out this morning that he has been arrested and charged with murder. By all accounts the case is very strong, and his conviction/plea is pretty much a done deal. That being said, I'd like to change my son's last name and also make sure that his bio father has no further influence in his life. (My son shares the same first and last name as his father, and in this age of internet searches I never want my son's identity to be confused for that of his criminal father's.) If my ex-husband is indeed convicted of felony murder, do I still need his permission to change our son's name and to revoke his other parental rights? All of this is very new to me, I just don't know where to start. Thanks!

Charged and guilty are different things. Wait till he is found guilty and sentenced, then ask us again.
