Hello,

Just today I received my EAD card for OPT. I have a job that I will be starting next week onwards (now that I have my EAD). That company has also filed for my H1, and I am waiting for my H1 acceptance. While waiting on my H1, I will work for them under OPT status (until H1 is granted). Now here is my question:

1. Which case results in less taxes, while being on OPT or H1?
2. Once I receive my H1, will OPT be cancelled on its own?
3. When I get my H1, should I cancel my OPT (will that be helpful in anyway, if that is possible)?

Thank you very much for this supportive website, and your time and efforts in answering our questions.

You are currently on OPT so your income is during your F1/OPT status. Your U.S. Tax Return: U.S. Tax Filing Requirements for Non-Residents (http://taxipay.blogspot.com/2008/03/us-tax-filing-requirements-for-non.html)

QUOTE," 2.Once I receive my H1, will OPT be cancelled on its own?3.When I get my H1, should I cancel my OPT (will that be helpful in anyway, if that is possible)?"---Yes. After your H1B visa is approved, then your OPT will be invalid, even though you have OPT expire date after H1B start date.
