Recently my daughter an son-law had a big argument and asked me to come and get the children early. When I got there he was leaving in car. We got kids in my car. He returned saying how bad she was, she was so up set, shaking , crying, telling him to leave. He went into house. I took a hold of her face an told her to calm down. He called the police. He told the police I hit her. I told them what I did and that he was in house at the time, my daughter comfirmed this. After they talked to us they let me take the children. Now they say she is a unstable parent and he could take the children away. This man stays up allnite playing video games and sleeps all day an cannot be woke up, she works grave yard shift and is afraid to sleep for to leave children a lone, they are 4 an 5yrs. They cannot afford a sitter.

. Now they say she is a unstable parent and he could take the children away.

Something unclear here-who are "they"?

This whole thing is a mess, so I'm going to try and break it down piece by piece.

You said:

Recently my daughter an son-law had a big argument and asked me to come and get the children early.
You say they asked you to get the children "early"; were you already planning on picking up the children? Or were they asking you to come get the children because they were arguing?

When I got there he was leaving in car. We got kids in my car.
Who got the kids into the car - you and your daughter? Or you and someone else? Who was present for all of this?

He returned saying how bad she was, she was so up set, shaking , crying, telling him to leave. He went into house. I took a hold of her face an told her to calm down.
He was bad-mouthing her, or he was saying he was concerned about how upset she was? How old is your daughter that you need to grab her by the face?

He called the police. He told the police I hit her. I told them what I did and that he was in house at the time, my daughter comfirmed this.
Why did he call the police? Just to tell them that you hit her, or is there something more? Why is he telling the police that you hit her?

After they talked to us they let me take the children. Now they say she is a unstable parent and he could take the children away.
Who is "they" - the police? What grounds would your son-in-law have to take the children away?

This man stays up allnite playing video games and sleeps all day an cannot be woke up, she works grave yard shift and is afraid to sleep for to leave children a lone, they are 4 an 5yrs. They cannot afford a sitter.
So why doesn't she leave him if he's such a dirtbag?

This whole thing is jumbled together and not making a lot of sense to me at this point. If you could answer most, if not all, of these questions, we might be able to better advise you.
