My boyfriend was arrested 2 years ago for a DUI. He was kept in jail overnight and released the following morning. He was charged with a DUI and the paperwork was mailed to him. There was some problem and he never received the papers and assumed the charges had been dropped. The court admit that there was a problem with the paperwork. He was in the wrong as he never followed up. He was arrested again a month ago for a DUI in another county. Once he was arrested this time, the DUI from 2 years back showed up on the system. Until then he was not aware that there was a bench warrant out for him. He was charged with the recent DUI and was moved immediately to the jail in the county where he got the first DUI. He is currently in jail there waiting for a court date.
My question is, is there a statute of limitations on a DUI in Georgia? Could you give me any advice on this issue.

Statutes of limitations only apply when charges have NOT been levied. The cops only have a certain amount of time to solve a crime. But, once they do, and charges have been filed, the statute of limitations doesn't apply.

If your boyfriend missed court a warrant was issued and a warrant lasts forever. His best bet is to hire a good lawyer.
