View Full Version : Amex has not sent a statement or contacted me in 15 months, should I stop payments?

I went bankrupt personally 19 months ago. I also own a small incorp. Business. It had an amex card. Not claimed under the bankruptcy. One month after claiming bankruptcy, Amex, sent a letterdemanding full payment and cancelling the card. Amount owing $16K. I decided to just keep paying what I could. No statement was ever seen, no phone calls, nothing. Last month I wanted to check my balance, no record of the account on the call in center, nothing. Should I stop paying and leave well enough alone? Is it possible it went under bankruptcy without me knowing? Thanks in Ontario.

They probably sold the account to a collection agency by now. That's why they don't have record of your account. No, it's didn't get discharged in your BK. I wouldn't stop paying. Certainly, you're going to pay it one way or another. When you hear from the collection scumbag, see if you can make a deal with him. I'll bet you can settle for $.50 on the dollar. Yeah, it'll be reported to the credit bureaus. But, your credit is shot anyway from your BK.

Only you know if you incorrectly listed it in the bankruptcy. So pull all of the records and see. Of course if it was not a personal debt, it should not have been discharged.

If they have no record, how or what are they doing with your payment.
