How do I evict a non-tenant from my rental property in California. The person is the ex-wife of my step-son. She moved out 6 months ago and now moved back in without authorization from the owner or the other tenanats. The Unlawful Detainer suit does not seem to apply being that there is no rental agreement. I am not particularly fond of this site (California Eviction Notice (http://www.expressevictions.com/california-eviction-notices.php)) but it gives the info you need.

This person needs to be evicted.

I purchased Nolo Book's California Landlords Law Book which has the same forms. The 3 day eviction notice seems to apply to the non-tenant because there was tenant harassment and also property damage done by the non-tenant. Thanks, Jim

Sure - let us know how it works out for you. How did the tenant get back in? If he broke in, you may be able to get the Police to throw him back out.
