In NJ can you sue someone who is having an affair with your spouse?

You can sue anyone you want. The difference is it a winable case?
Why not just sue the wife for divorce? What are you going to get out of suing the person she is having an affair with?

No! You have no legal grounds to do it.
Legislation was enacted to abolish the right to bring an alienation of affection lawsuit in the state of NJ.
It is against the "public policy'',because every person has right to be adulterer.;);)

... but have in mind that l marital fault or adultery is not listed as a factor in the alimony statute to determine alimony in NJ.

In many states alimony isn't even given in many cases these days.
