My question is,the father of my children had me served and exparte hearing, after I already received court papers to modify the custody Tues night I just got done and filed my response by 1:30pm today which is Friday, will the judge still look and review my response because that Monday I have court in the morning. It was difficult for me to get my papers together and filed by today (friday),but I did it.
He had in those papers just slandering stuff about me,and my kids. He is asking for full custody.. saying my kids have bruises, and that I don't have a bed for when they sleep at night. Bringing up my past when I used to have a alcohol problem etc.
Will the judge most likely give him full custody based on what he writes in his Exparte Hearing... NOne of its true, how else can I make the judge believe me?

What was the declared emergency situation for the exparte? As far as proof (like no bed) just be sure to bring pictures with you. When was the last custody order approved?

Do you have a record of how long you have been sober? Can you submit to testing? Do you have pictures showing the beds. Do you have their pediatrician's statement that there is no bruising? Since he is bringing this action he needs to provide proof. If you can provide any evidence showing he is lying, the courts will probably side with you.
