View Full Version : What is the statue of limitations Illinois on voluntary dismissals by agreement?

In 2007 in Circuit Court an agreement was reached between the attorney for the Plaintiff and myself to dismiss and clear what I describe as a 'bogus' credit card debt. Their suit was "dismissed by agreement without predjedice". Now over 3 years later an entirely different company is coming after me for the SAME account that was dismissed at the first court hearing. Can an unrelated 3rd party do this and isn't there a statute of limitations for refiling... though at this time they haven't refiled... just demanding payment of the account supposed agreed as wiped back in 2007??

Relax!

Now-a-days, companies sell their un-collected debts to other companies for a fraction of the face value.

Those companies then try to collect the full face amount.

Since your suite was dismissed, all you have to do is prove that the claim was bogus to begin with they should the leave you alone. If you do not, have your attorney talk to them or refer the matter to the Clerk of the Court for assistance.

Send this new company a copy of the court order and tell them that any further attempts to collect this debt would be referred to the FTC.
