We have a missing 8 yr. old grandson.
He was abducted (by Illinois standards) by his mother a week ago.
South Carolina P.D. confirmed that my grandson is out there with her at her home.
His father has temporary legal custody of him in Illinois.
The Chicago P.D. Investigator filed a missing child report.
The Chicago investigator initially said that upon her returning my grandson they will arrest her.
But now that they have spoken with the investigator decided that they will not arrest her because she has two other children. (that reside with her and her second husband in S.C.)
My daughter has no consequential thought process and has no remorse factor and has not had these since the age of around 8yrs. Old...
I defended her ex husband the grandsons dad in the custody battle, as I know her mental status... and truly know he is the better parent.
I do NOT understand why it has been over a week now and no effort to go to S.C. has been made to get my grandson!
And I cannot believe that the Chicago P.D. is now refusing to press charges.
I understand that we want our little guy back, and that is our MAIN concern... but with the "behavior" type my daughter is... the ONLY thing that slows her down is reprimanding. She laughs at the authorities saying what idiots they are and how she got away with that one... She had children before she committed this crime and still committed it... so the police need to do what is lawfully correct.
She will not be told she cannot do what she wants... but if you let her get away with it she will continue this way!
She claimed she'd return last Wed. and she didn't... and she claimed she'd return tomorrow (Fri) so I am going to the Chgo P.D. to wait again for her...
Then the court date for the judges order of her to return my grandson and show up is this Monday. We feel the judge is going to give her supervised visitation at a Chgo. Facility.
So... My other issue is if we are granted supervised visitation by a professional...
HOW SHOULD WE ASK OUR ATTY. TO WRITE IT OUT SO WE HAVE NO WIGGLE ROOM ?
She is a con artist and she will find the slightest out... We want my grandson to still see her but with someone guarding him at all times and what about cost and where and time constraints etc??
CAN ANYONE HELP MAKE THIS BURDEN LIGHTER FOR US PLEASE...

Was a missing child report actually filed? Do you have this in your hands? If you do you can try calling the FBI as this is a federal crime when crossing state lines. Its kidnapping plain and simple. You need to ask your lawyer what the options are as far as supervised visits. She represents a flight risk. Had this been your son doing this he would have been in jail already I would think. The fact that she has other children has no bearing on your case against her.

I'm going to try to break this down bit by bit.

Can you elaborate on this a little more? What do you mean "by Illinois standards"? Either he was abducted or he was not.


His father has temporary legal custody of him in Illinois.
But what type of physical custody does he have? What does the court order state?

Something is being misunderstood. The police will not avoid arresting someone just because they have children; why do you think Child Protective Services exists?

I don't understand this. You have an attorney already? Why is s/he not talking to you about this? Their job is to represent your best interests. Haven't you asked your attorney any of these questions?
