Discover is suing me for 2,000 over a credit card I stopped using and paying for in 2007. I went to prison and was released a few months ago, I owe the Feds so they are taking 10% of my income and I am starting to pay off my school loans. I've searched all through the site and found lots of help but I'm not sure if I should try and fight this.
Should I file an Intent to Defend & a Discovery and go from there?
Thanks in advance for any advise

Thanks Scott, I'll go for it. Any idea how this might play out?

If it's a junk debt collector, you might get out of it or you might get offered a settlement. If not, you will probably have a judgment placed against you.

I just got a letter today from the same attorney representing Discover, this letter is threatening to file a lawsuit against me if I don't pay off my Capital One balance. Did this lawyer buy these debts or something? Same lawyer, two different CC companies.

Don't know, doesn't matter. As long as they have a right to collect the debt whether as the current owner or assigned by the owner.

This debt was "past due as of Feb 2007, Charged Off as of Aug 2007" The Statute of limitation is 4 yrs where I live in TX, but 3 yrs in Delaware, where they are. Any way of using their SOL instead of mine? Thanks,

Nope, Nor does the fact that its charged off matter.

Postman tried to deliver a certified letter from the lawyer when I wasn't here, any idea what it could be? 5 days before trial? The trial was moved from Wed to Fri, but doubt the lawyer would be so eager to tell me that.. Should I go pick it? Thanks,
