View Full Version : How can I get custody of my nephews

My sister's kids were taken from her and now the services are not letting her get them back. I wanted to know if I went to the state and talked to them what my options are. I want to know what I am legally able to do. I want to request to get custody of 2 of them and a few of my family members try for custody of at least 1. This is a hard situation because there are 5 kids in all, 3 boys and 2 girls. I just don't trust them to be in a foster home. How should I approch this and what are my options!

Certainly - contact the Social Worker assigned to the case, make an appointment and discuss the options. How long have they been in the State's care?

From what I know they have been in custody since May. Now I am not sure the date because my sister was telling the whole family that the kids were visiting one of the childrens' dads familiy. They are currently in NC.

You could try for a residents order,that's what I got for my grandaughter who now lives with me and my husband and we have parental rights now

I agree with Judy. First you will have to contact the social worker for this case, if you know who it is & the case number it will make it a lot easier to find the chidren in the data system. Being you are a family member, the social worker will do a check on you as well as anyone in your household to make sure no one has a criminal record. Secondly, a lot of times the system will allow the chidren to go live with afamily members either temp. while finding a home for the kids, or perm. If you choose to adopt them if that is in this case to do so. I know being in two diff, states one social worker will prob. Get ahold of another social worker in the state you live in, and have them check your home to make sure it is in good standings for the kids to come to. I wish you luck...

Please take more care when choosing a forum to post in. Your question was not about adoption but custody. Also it was a legal question. So its been moved here from the Adoption forum

I agree that you need to talk first with the caseworker. Tell the caseworker you are willing to foster the children. They will prefer placing them with a relative. You will probably be granted guardianship in the short term. From there you can talk about custody or possible adoption.
