View Full Version : Can a drug test be monitored with camera or through a mirror?

I am in pre-trial intervention and have to have drug tests. Friends have said someone goes in and watches them provide the urine sample. No one went in with me, and I'm wondering if they watched by video surveillance or through a mirror? I looked it up online and did see some stuff about surveillance. I know in normal circumstances it is illegal to put a camera in the bathroom, but don't know about this situation. Anyone know? I'm in South Carolina.

Its illegal to put a camera in a bathroom used by the general public, yes. If its part of a facility specifically designed for this activity, it may be legal. Were you searched at some point prior to providing your sample? They may have deemed this sufficient.

Ok, fessing up. I'm asking for a friend. For simplicity sake I used first person. He said they didn't search him. I looked online, and the facility is a drug treatment center/hospital. He failed a test two weeks ago.

Wouldn't they have to disclose that they were monitoring? And if he did something wrong, like use someone else's urine, wouldn't they have arrested him? I think there was a push in sc to make defrauding a drug test a felony. His test was Monday night.

No, they likely would not have had to notify him and if he was caught, most likely would have been arrested on the spot.

Did he use someone else's urine?

If there was no law enforcement present, its entirely possible they just reported the violation and your friend will be arrested or violated at a later point.

Often someone merely goes into the room, but most of today's test can tell the temp of the sample, so if it is a bottle or bag of urine they use instead of fresh, the test will normally just automatically fail now under most current testing.

Most new containers have a thermometer on the side of them.
