View Full Version : Is my lease valid if we didn't give a deposit?

Hello!
Keep in mind I'm not suppose to move in until AUGUST 1,2010!

I will try my best to make this short and not confusing.
In January three friends and I went to go sign an application lease for a three bedroom apartment. We signed when they were having a promo called midnight madness, where we didn't have to give a deposit. Four months later one of the girls called me and said that her computer crashed while signing the lease so she wasn't actually on it, and she didn't want to live with us anymore. I called the landlord and explained my situation and she said that since we hadn't given a deposit we just wouldn't get our application fee back. A week later the landlord called me back and said that I would be held accountable for finding a subleaser for the apartment or I would have to pay a full years rent! I have tried to find a subleaser and no one is interested, simply because they don't even have a one bedroom to show!! Also, on their homepage they don't even show that a one bedroom is available. Even though I told them that I would not be moving in August 1st.I asked if they would post that it is available, and they said they couldn't do that since it isn't "truly" available even though I have tried to give them a 90 day notice of termination and they said they don't do cancellations. I also asked them how I can sublease when I don't even know my building or apartment number. They told me that I still have to sign a unit lease and that my application lease is holding me to renting with them. I feel like there is just so many different things going on with this situation. Do I have a chance of getting out of my lease?

You don't HAVE a lease. You signed an APPLICATION. It obligates you to NOTHING. Tell the complex to pound sand.

Yup. You made an application only. Lease would only come into play if you literally signed your name on the dotted line.

You didn't literally sign anything if you did it online. A waiting List is just that - a waiting list. The lease is only valid once you sign it in ink - not over the internet unless there is some sort of wording that says once you type your name on the form online you've agreed to the lease. Go back and re-read just what you filled out and that should give you your answer.

They can try to take you to Court but don't get worried until you are actually served with a Summons and Complaint.

Have they contacted the other girls and given them the same song and dance they have done with you?

Only one of the girls, but they are telling her that she is just responsible for finding a subleaser for any apartment with them (one, two or three bedroom or rent by room). The other girls computer crashed so they said that they cannot hold her resp
