My husband is a salaried employee in Tennessee. As of the last few months, he has have to work apprx 12 to 18 hour days because another manager quit and he has to cover his shift too. He is only compensated for 8 hrs daily. When there is a scheduled doctor's appt or time off is needed he is still asked if he is going to use leave or a floating holiday, etc. Is this legal?

Yes, sorry but a managers pay is not based on a number of hours. He may have assumed it was and agreed to lower pay than he should have. But as a manager he has to work 12 or 14 hours a day 7 days a week if the company needs him to

Thanks Scott. We are looking into some other venues. He ended up working 25 1/2 hrs straight yesterday. Ridiculous! 7:30 am Monday until 8:30 am Tuesday. I am so worried about his health and safety operating with no sleep.

If this is what his company is doing to him maybe he needs to find another position elsewhere. Sometimes being a manager is great and all for the prestige of the position but a bear when it comes to doing all the extra hours the company needs a manager to be on the premises.

What has the company said about hiring a replacement for the other manager who quit? Any time frame when someone else is to come on board?

There are some issues on time one can work without a break, but that will vary by state ( in the US)
