View Full Version : Name is on a lease but you did not sign, but I paid the 1st month

My boyfriend and I signed a lease to rent a house. My boyfriends aunt also verbally agreed to move in with us and paid her portion of the 1st months rent. She did not sign but her name is on the lease. Now she changed her mind and we cannot afford the other half of the rent. Can we do anything?

I'm somewhat confused - your aunt is not a party to the lease if she didn't sign it. This is a matter of a legal contract. The landlord allowed you to move in when the lease was not signed or was signed by 2 out of the 3 parties?

You can always sue her based on her verbal contract with you for her half of the lease UNTIL you find another tenant to replace her.

She will argue her position; you will argue yours; a Judge will decide.

The aunts name was included on the lease not as a Lessee, but as 1of the individuals that will be occupying the premises. The landlord allowed us to move in with the lease signed by 2 out of the 3 parties

You are still unclear. You said the aunt was not listed as a leasee so who is the third person who didn't sign?

Now I'm REALLY confused. You and your boyfriend were on the lease, signed the lease. Your aunt is listed as a person who will live there? That does not bind her to the terms of the lease.

Otherwise my advice is the same - take her to Small Claims Court for her portion of the rent until you can (reasonably) find someone to take her place.

And so forth.
