View Full Version : Evection of tenants va foreclosure

The house I have been renting for two years is being forclosed on. The lease expired 6 months ago so I have been month to month. The landlord sent me a letter saying I have 30 days to vacate. That's not a lot of time. What are my rights? How can I find out which bank is foreclosing? Would be curious to ask if they want us as tenants or will give us assistance to move out.

As long as the landlord wants you out, since you are on a month to month, he can give you one month notice and you have to vacate or face eviction.

Conversely, if you wait for the foreclosure to be finalized, the new owner has to give you 90 days.

The bank will not want you as tenants, they don't want to be landlords and they have no incentive to offer you moving assistance.

Its possible the landlord is trying to do a short sale and needs you out.

You can approach the landlord and see if they can give you more time.
