OK, so as far as we know my husband is the father of his ex's child. We are still pending the custody case right now to see if he really is. She is engaged to her long time love now who could also possibly be the father, but in either case my husband wants to sign away his rights for this man to adopt or have his name taken off upon the test showing he is not if that is the case. Is there any way that this will not happen the way everyone wants it to? And after he's taken off, can the other man put his last name for the child?

First off he has to be the legal father for anything to happen. How old is the child? Are child support orders already in place?

Unless the mother is giving up the child she needs to be married for at least a year for an adoption to take place in most states.
