View Full Version : Can I stop a potential wage garnishement buy offering mthly payments?

I am being threatened with wage garnishment. I am almost debt free, and I am already paying these stupid creditors. They called me and said that my payments aren't enough. I'm in school and they ant to take more money away from me. First off, I want to know if they can even apply for a Notice of Garnishment when they know that I'm a student and paying them an amount every month. Secondly, if they can, can I counteract the garnishment by offering to pay more in order to have the debt settled at a lesser amount?

Hello no:

IF there's a judgment, they can garnish your wages and you can't stop them. You certainly CAN make arrangements with them. Even though they have a judgment they don't have to garnish your salary.

But, if you can pay more, why not make the offer NOW instead of waiting?

They can't garnish your salary without a court order unless these are student loans. Otherwise being a student has no bearing.

They do not have to accept your payment offer, however, if they have the legal right to garnish your salary there is nothing you can do to stop them.

I was just wondering if garnishment is allowed even though I am making mthly paymwents. Also, I live in Ontario, Canada

Unless there is an agreement not to garnish as long as you are making a specified payment, then yes they can garnish you even while you make payments.
