My commonlaw partner and I of 10 years are separating. We have a house together that is in his name only due to a previous bankrucy on my side. Anyway we have had the house for 3 years now and I have been paying the mortgage and all bills however nothing is in my name. (I do have a paper trail to prove this). We did not have the money for the downpayment on the house, so my grandmother gave "him" a loan for $20000. For the downpayment, a contract was signed but he has never paid the money back, a suggestion by a friend was to put a "lien" on the hosue so that she will receive the money back. Any suggestions on how to do this or what my next course of action should be in regards to the whole scenario would be appreciated.

You can't put a lien on the house without a judgment, plus there has to be enough equity in the house to carry that 20,000. Plus court costs. If you want the money back you will have to see a lawyer because I think 20,000 is too high for small claims court. What I am trying to say is, you will have to put out a little money to get the big money back. Get your paper trail together.
