View Full Version : Tenent breaking lease/option 2 1/2 yr. Early what rights do I have in Ohio?

My tenents signed a three year lease with the option to buy on my mobile home and just informed me that they are moving out in a month 2 1/2 years early on lease. They have quit paying rent and still owe over 750.00 from security deposit and back rent. What legal rights do I have in the state of Ohio?

Your rights are contained in your agreement. Certainly, there's stuff in there about what to do if someone breaks the lease... If not, then you have to evict them according to Ohio landlord tenant law. We have a copy of it at the top of the real estate page on a sticky note.

In MY state, you can make your claim for rent at the same hearing. In others, you have file separately.

Sue them in small claims court. Are there more details we should hear? Do they state a reason like the home is uninhabitable or unsafe?

I would read the terms of the contract carefully. Generally a lease with option to buy is not a rental lease, but a contract for sale. The contract should, as excon stated, detail what happens if the buyer/tenant defaults.

Tell us what the contract says and we can advise further.
