For two and a half years. My exboyfriend has been making side payments to my landlord for rent (which the both became close friends.) I recently found out what was going on because we are no longer together and the landlord requested that I pay him this extra money. I told the landlord I am moving because of this. I never knew or made the agreement with the landlord. He informed me if I do not continue to make payments that he would take me to court for non payments.

A friend said I can take the landlord to court to pay back the money my ex gave him for my rent. And that what he was collecting was unauthorized side payments. (im on section8.
Question would I be able to collect that rent back since the money he was giving the landlord was for my rent? I have proof he paid my landlord I saw the copy of the checks on my landlords bank statements. He showed them to me during a spat when I refused to pay him the side payments

Yes, in section 8 the landlord gives the official rent to the government agency, they pay an amount, and you would pay the amount you are to pay according to section 8. If he is requiring more money than the section 8 authorised, not only may he have to pay you it all back, but he could even end up in jail for fraud

Im not sure If I am replying in the right place. I would like to say thank you FR_Chuck.
I would also like to add. For the two 1/2 years from what I counted he collected. 13,595 dollars from my ex when he should have collected from me only 1,488. It's a huge difference. Section 8 of course made their payments on time.
I am in the process of locating a lawyer. I just wanted to make sure that what little my friend told me was right.
Would they pay my ex his money or would he get in trouble as well for doing what he did?

Maybe I'm not reading this right BUT you can't sue for someone else's damages. If your boyfriend paid unnecessary monies, HE has to sue.

Yes, he could be in trouble.

Yes, the landlord could be in trouble.

This is against the Law.

JKT brought up a very salient point here. You have no standing to sue your landlord for monies paid by your boyfriend. You can, however, report the landlord to the government and have HIM explain why he was taking extra money. You can also report him to the government for advising you that you need to pay him the extra money each month. He will end up in jail for fraud over this situation. I guess he's not too bright when it comes to obeying the law regarding Section 8 rentals.
