You file a motion in your local Family Court. A lawyer can assist you in this process and is preferable to doing it yourself. (S)he can fill you in on all the details concerning documentation, what you can reasonably expect to collect, etc.

Please pay more attention to posting guidelines. There is a Read First sticky in the Children forum (where this was moved from) that directs questions of a legal nature to this forum.
Why have you waited so long? You go to your local Family Court. They will tell you the process. Or better yet, hire an attorney to file for you.

You file the same way you do if he is single,
Also have you ever got a custody order, giving you custody of the child. Does he have court ordered visits.
You will need to file in court for custody ( if not already) and for child support.
