View Full Version : Nonmarried father's rights when mother abandons child with grandparent

The child's mother left daughter with maternal grandmother and has been on a drinking binge for 6 days. Now the maternal grandmother is refusing to bring the child home to me. The child's mother and I were never married and I would like to know what I need to do in order to get my child back from the maternal grandmother because she is now stating that she is going to have the mother committed and keep the child indefinetly. What are MY rights as the father and what steps do I need to take to get my daughter back?

You go to court to have custody awarded to you. You bring in the proof that the mother has been on a drinking binge for the last week leaving the child with the grandmother and let the judge rule on it. Are you legally established as the father? If not, then that is the first thing that has to be taken care of. If so, do you have visitation ordered? If so then go to court to at least have that enforced as well as the custody modification.

You file an ex parte motion with the courts for custody stating your reasons. You have already taken a DNA test and are paying on your child suport right? Is your name on the biirth certificate?

Not on birth certificate but do have a dna test signed by both of us
