Hi I have a tenant who is section 8 and who is trouble--(noise, pot, intmidating neighbors.. ) the housing office made an error on her lease which says she it ends in May the housing is telling us we knew it didn't end until November because all their leases are one year--this is her soconfd lease with us but we knew of no such rule and planned to sellt his summer anyway and didn't care--its signed by housing, the tenant and my husband--will it be upheld in court? We want her out asap--should we hire and attorney--if yes--for what? Doesn't housing have a responsibility to find her housing?

It's not what you know or should know - it's what was signed. If it was signed and the dates are wrong, it's a valid lease until changed/amended by another written instrument.

I'd move to evict her according to the laws of your State.

I believe the lease is valid as written - May is the end.

If she is a disturbance or a danger I'd evict her now - although you probably can't get her out until the end of May, anyway.

I would leave out the "planning to sell" part because it sounds like you have some other motive for evicting her.
