View Full Version : What happens when respondent doesn't show up to child custody hearing

My 12 yr old step daughter lived with me and my husband due to her mom being unstable and a substance abuser,my husband had primary custody until an incident between us put him in jail.I was awarded guardianship for 4 months, her mom got her back after that.she was evicted before my husband got out and no one had contact or knew where she was for six months.when we finally found her her mom sent her back to live with us she has not shown up to the last 2 court dates and the judge simply dismissed the case, and said there are no orders.what can we do about this.

If he did not change any previous court order, the old one is in effect. ( since he did not rule on any new motions)

Sounds like you have no attorney since when they did not show up, did you ask for the case to be ruled in your favor ?

Also when you face someone that has a history of not showing up then you need to have the courts issue a bench warrant so they appear. If they do not appear then there is a warrant issued for their arrest. The courts don't like their time being wasted. Also cover all bases as far as service goes.
