View Full Version : Insurance paid off my car but still owe money

A dunk driver hit my car a totaled it. His insurance company paid the book value of the car and I also had insurance plus GAP Insurance on the car. This happened in 2004. Each year since that time the Bank has been writiing me stating that I owe $321.00 because the payoff did not include late fee and the last payment. I don't think they desire the 321.00. What should I do about this. I signed the check over to them from the insurance company which included my rental reimburstment and GAP took care of the other. But they're stating GAP doesn't pay for late payments and fees. I don't understand this. We asked for a total payoff amount for the Insurance companies and that's what I thought they gave me. Now 321.00 is 799.00.

Why do they not owe the late fees ( did you keep the payments up till the payoff happened ) were the fees allowed in your contract.

Did you check the payoff of the car before you settled with the insurance company? To be blunt, you needed to know the payoff and know it was the proper amount.

Unless you can prove that you don't owe any fees you will need to pay them
