View Full Version : How do I stop automatic child support payments from my check when child lives with me

I am a non-custodial parent who pays court ordered child support, the custodial parent as well as myself are in the Army I am currently deployed returning in Nov. She will be deploying in July. When I get home obviously my son will be with me because we have Joint legal Custody, how do I stop the payments coming out and isn't she supposed to pay me child support when I have custody of our son?

Whether she is supposed to pay you should be part of the support order. You really should go back to the court and have the order modified to reflect the joint custody.
The only way to stop the payments is by court order.

You will have to go back to court and get a new court order changing you to the custodial parent, The issue of where the child actually does not change anything, except your right to file for a change.
You need a court order that works for who is deployed.
But until you get the court order changed, you have to pay
