View Full Version : Ssn/medicare required for 1099misc non-employe?

Hi I have a
1099 misc non employee compensation for 19000. I am a non resident alien (india) on h1b since 12th dec 2008. However I have not entered the us on this h1b. My employer pays me non employee compensation only.

so am I required to pay ssn/medicare? Isint it only applicable for employees?

since my non employee compensation is 19000. My tax is
19000 - 3650(exemptions for alien line 39) = 15350
For 15350, the table gives tax to be paid as $1889

Am I correct in assuming this is the tax to be paid. I donot have any other incomes.. etc.. etc in india.

People paid by US companies pay into the SS system - I am a 1099 employee and I pay my own SS because I have no employer.

Thank you judy for the quick response.

I am not employed by the company as they are paying me non employee compensation as reported in 1099misc.

But the h1b I have from them would make me an employee only if I where to enter the US. But I have not entered the us for 2009 on h1b visa.

In your case since you are an us citizen you would need to pay ? Btw I do have an ssn as I was a F1 student in the us from 2004(aug) - 2008(jan).

Bottom line: if I do need to pay, how do I calculate ssn/medicare?

You will report the income on schedule C or C-EZ (Form 1040). On your net income on C or C-EZ, you will pay SE tax at 15.3%. Your U.S. Tax Return: Tax Filing by Self Employed Sole Proprietor or Independent Contractor (http://taxipay.blogspot.com/2008/04/tax-filing-by-self-employed-sole.html)
