View Full Version : F-1 student that moved from CA to WI and has had F-1 for 5 years

Hi,

So this is my story...

I got a F-1 visa to attend a summer program in 2004 and then attend college in US from 2005 to 2009 and started graduate school in the U in 2009. So I have had 3 F-1 visas (from different schools) in total, so do I count as a resident alien for tax purposes now? In case, I am a resident alien I have to fill the 1040 instead of the 1040NR, correct?

I also received two 1042-S forms, where do I put the amount on the 1040 (I know where to put it on the 1040NR, but not the 1040) and where would I deduct that amount again because of tax treaty exemption?

I am now in graduate school in WI and have been living in WI since August... on the 1NPR form am I part-time resident or a nonresident?

After 5 years on F-1, you will file resident tax return. You must report 1042-S income. Normally you do not get treaty deduction after 5 years except if allowed by the tax treaty.

It is allowed by the treaty. It is one of the infinite amount infinite time treaties

I am not sure if you take take treaty deduction as the payment was made by a U.S. company or employer.
If you want how to report deduction, show it as negative amount as Other income and write "Exempt German U.S. tax treaty....".
