View Full Version : No lease and tenant dispute over repairs

My relative, Barb has a tenant in her rental house who has done repairs and upgrades. There is no lease and the tenant wants to be compensated for the money they have paid for repairs and upgrades. Barb wants the house back and the tenants to leave so she can sell the house. The tenant claims $5,000 in repairs and upgrades and has agreed to take the money in rent and has stopped paying rent until the monthly rent amount has paid down the $5,000 owed. Both Barb's lawyer and the tenant's lawyer have been discussing the issue, however no agreement has been signed and I really don't why.

I have the following questions:

1. Can the home be sold while the tenant is still in the home?
2. Can the tenant be given 30 day notice to vacate the premises and the $6,000 repair issue be settled with the lawyers or does the repair charges have to be settled first?

Yes. Happens all the time.



2. Can the tenant be given 30 day notice to vacate the premises and the $6,000 repair issue be settled with the lawyers or does the repair charges have to be settled first?

Yes. If there is no lease, the tenant can be evicted. How much is owed by one or the other is a separate matter. And it it can't be settled, it can be litigated. But in either case it would not affect the owner's right to the premises.
