OK here's the deal I'm 26 and all my life I have assumed my father was well my father.When I went to get birth certifacate the last name was different then what I use it was my brothers dads name my brother and his dad told me that he was my dad we did a dna test it said he was my father OK so on my birthcertifacate it says baker on my driver licene it say barker on my ss it says barker along with everything else. So is my legal last name baker or barker cause that's what I've gone by all my life.
Just so were clear baker is my legal fathers name and barker is my legal stepfathers name.

No I was not adopted by my stepdad I was just never told about my bio father thought my stepdad was my bio dad my whole life I'm not sure how the got my last name the same as my stepdads but I know I wasn't adopted by my stepdad

It wouldn't be the first time it was left blank to begin with and filled out at a later date. From the sounds of it Id say that is what happened. Your old enough now you can change it yourself if you want to.

Your name is what the birth certificate says it is until you change it.

I was told the other day that my name legaly was what I have been using for the last 26 years not what my birthcertifacat says

That's not true. Your legal name is that on the birth certificate and ss card.

Your legal name is what is on your birth certificate, you are allowed to use a "fake" name if you want, but it is not a legal name.

How did you get a Drivers license in another name ? Since some legal ID is normally required.

But anyway, if you want to use the other name, you need to go to court and get a name change

When I got my permit I think I had my ss card hospital thing mabey school stuff and mabey babtism certifict

Well you can't use those any more, at least in the US, but anyway, actually your drivers license could be considered void since it is not under your legal name.

If someone really got hard about it,

What do you mean your brother? A brother is the son of both your legal mother and legal father. In other words, your brother's dad would be your dad, by definition. Do you possibly mean your step-brother (neither of your legal parents is his parent, but one of your parents is married to one of his parents) or half brother (the two of you have only one parent in common)?

They told you that "he" was your father. I'm assuming "he" isn't your brother, so it would be your brother's dad. The DNA test said "he" was your father. "He" would be who?

OK so my brother before the dna test I thought was my half brother turns out he's my full brother
My biological father is my brothers dad that's what the dna test said
So I grew up thinking my stepdad was my biological father he's not
That's were the barker name came from the one I've used my whole life
My real bio fathers name is baker that's what's on my birthcertifacit

Did you apply for your SS or did your mother? Are the names really as similar as you say (I assume they aren't the real names) or are they completely different?

If they are that similar, your mother could have chalked it up as a typo when your SSN was obtained. If not, then getting your SSN with a different name may have been a fraud.

Those are the real names. My mom got the ss card when I was born or sortl after I guess. I lost my ss card this year had to get a new one and the father listed on the acount was barker my step father it actually said barder but that was a typo I assume they almost didn't give it to me for that reason. Then when I had to go renew my license I had to get birthcertificat the dmv almost didn't give me my new license cause of the birth certifacat saying baker the dmv said that they would give me my licence cause that's how it was done in the past so my driver licence still says barker. After all that crap is when I decided to do the dna test

I don't know what you are asking - it appears that, confusing names aside, you were able to get the documentation you need.

I'm assuming my father is listed on my BC. I have honestly never checked nor has anyone ever asked me.

This time around I was able to get what I needed. I was told I wasn't able to get a passport if I needed one. What I'm trying to figure out is what name is my legal name then I need to figure out what to do once I figure that out.
This is all confusing

Your legal name is the name on your birth certificate unless/until you get it LEGALLY changed.

This is a big pain in my a$$
So inorder to change my name on dmv records I would just show them my birth certificate and the same with ss card?
The what would I do about my children cause on the birth certificate it says what I thought was my legal last name. (barker) then what about my marrige it says what I thought was my legal last name. (barker)

As I said, because the names are so similar, I suspect things were allowed as a typo.

I think it would be easier for you to change your birth certificate then everything else.

Yea but it wasn't a typo how can u change the birth certificate my moms name was still baker at the time I have no father listed on the birth certificate she was still technically married to my biological father

In most states if a child is born during a marriage, the husband is considered the legal father unless challenged. Therefore, her husband at the time is the legal father. Ergo your legal last name would be that of your mother's husband at the time of your birth.

If all your other ID is in the name of your step father, then go to court and have your legal name changed. It should be a simple matter.

Go to Court and petition for whatever name you want to use from here on - the real name, the other name, some name you have randomly selected.

A Court Order will end the confusion forever.

When you go to court you can name yourself whatever you want. So just pick the one you want and make it legal if it is different from the borth certificate. If that is the one you want to keep then you have to fix the rest of them.

Then you will need to change all your other ID instead. That's why I suggested it would be easier to change the birth certificate since everything else is in the name you have known.
