The judge is supposed to look at what is in the best interest of the child. If it's a stable relationship and you're both good parents, I don't see why it should be a problem. My uncle got custody of his daughter when he was living with a divorced woman and her son. That wasn't an issue for the judge. He lost custody a few years later when they were married and CPS found out both of them are terribly abusive... that single factor all alone shouldn't make or break your case.

Is the child being mistreated, does the child have proper food, housing and care.

Yes the child is cared for , sent to school, and taken care of. It would be a shared living arrangement t osave money purpose only. Just casual friends. But the child would have to share my room. She is 4yrs old.

I had to live with friends and I have 3 kids we shared a room ( me and kids) . Judge was fine with it as long as kids were well taken care of and loved. You should be fine schools have a form called a multifamily form just stateing that your current address is a shared home.

Do you feel the father will challenge custody? Unless someone makes a complaint about the arrangement, there should be no problem.

The father has a big house so I was concerned that may seem like a better environment because he has more money. But he is over extended and hasn't paid child support for months at a time.

Better environment means little, as long as you have a clean and safe envioment.

If merely being richer does not give custody. In fact often they look at how wealthy he is to be sure he is paying enough child support
