My ex wife has physical custody of my daughter in Nebraska. I live in California. My wife has made the statement that she wants me to move my 17 yr old daughter and her 4 yr old son to California with me. Is this possible and how do I do this legally? Can this be done without me in Nebraska?

Often custody changes can be accomplished without appearing in Court so long as the parents agree to the change. However, it is very important to memorialize any agreements made as a court order by submitting a stipulation and order to the court asking for the Judge’s approval of the arrangement. Agreements that are not memorialized as part of a Court order are generally unenforceable.

You will hire an attorney where the current custody agreement is at ( you did not tell us that) and file a motion to change the custody of the children, if your ex agrees, she merely signs off

This is merely a change of custody
