My son just died on Saturday. He left behind my beautiful grandson and I think I need to file for grandparent's rights. My grandson's mom says I don't need to do that, she says she would never keep him from me. My son shared custody but was the main care taker of my grandson. Some people have told me grandparents don't have rights. Can I file for grandparent visitation and companionship rights? Do grandparents have rights? No autopsy has been done yet, so I don't know an official cause of death. Also, yesterday the mother of my grandson told me she never wanted my grandson and never would have had him if my son had not talked her into it and convinced her that he would be there for her and take care of the baby.

I am terribly sorry for your loss. My wife and I have lost children during our lives and nothing I can say or anyone can say will ease the hurt. I will offer you up in my prayer this evening.
Unfortunately, most states that I know of do not really have Grandparents rights. We ran into this when our grandchild made her appearance. Fortunately, while our relationship with "Mom" was at times rocky we have been able to see our grandaughter.
My strongest suggestion is to remember that your daughter-in-law is also in a great deal of pain. The loss of your son was a loss of her husband.
If she says not to worry about anything, I suggest you say thank you and try very hard to befriend her.
Sharing your losses together may bring you closer and enable you to ease your worries.
Again, our deepest sympathies are with you, your daughter-n-law and your granddaughter.

Thanks Don :( I filed for my rights today in juvenile court, I called a friend who is a lawyer and am following his advice now. In Ohio, I have rights. I am not trying to get custody, just visitation and companionship.
