I have 10mth old son and my girlfriend moved in with us for month, everyhing was going well my own parrents were taking care of my son for most of the time because my girlfriend was doing late night parties . Sh dosen't want to work and I work 12 hrs very day. One night my girlfriend came home 3 am and took my son from my parents and went to bed and she told my parents that they cannot hold my son. Next morning it was 1120 am I got call from my parrents that my son is crying and crying and my girlfriend dosen't want to wakeup to hold him and was ignoring him so my mother steped into the room and asked my girlfriend to pick up the child she said to my mother leave he room.

The fact that you are not married to the mother has almost no bearing here. What you do is what you should have done when the child was first born. You go to court and establish custody.

I'll assume you are listed on the birth certificate as the father. That gives you equal rights to your son. In other words Joint legal custody. But I think you want to go for primary physical custody if the mother does not properly take care of your son. To do this you need to go to court and petition for it. I suggest you consult with a Family Law attorney immediately.
